These Terms of Service (“Terms”) govern your use of https://imprettyselfish.com and purchases from Pretty Selfish (“Pretty Selfish,” “we,” “us,” or “our”). By visiting the website, creating an account, or placing an order, you agree to these Terms together with our Return & Refund Policy, Shipping Policy, and Privacy Policy.

1. Eligibility and sales territory

You must have the legal capacity to enter into a contract in your province, territory, or state, or use the website with the permission and supervision of a parent or legal guardian. Pretty Selfish currently serves customers in Canada and the United States, with the store primarily directed to Canada.

2. Products and product information

We make reasonable efforts to present product descriptions, colours, images, ingredients, contents, dimensions, and application information accurately. Screen settings, lighting, packaging updates, and manufacturing variations may cause minor differences. We may update product information or discontinue products without notice.

Pretty Selfish sells gel nail stickers and related nail accessories. Our products are not plastic press-on nails unless a product page expressly says otherwise. Always read and follow the application, curing, removal, ingredient, allergy, and safety information supplied with the product.

3. Orders and acceptance

Your order is an offer to purchase. An order confirmation acknowledges receipt but does not guarantee acceptance. We may refuse or cancel an order before fulfilment for reasons including product unavailability, pricing or listing errors, suspected fraud, payment issues, shipping restrictions, or order-limit violations. If we cancel a paid order, we will refund the applicable amount to the original payment method.

You are responsible for providing complete and accurate billing, contact, and shipping information and for keeping it current.

4. Prices, currency, taxes, and payment

Prices and promotions may change without notice. The currency shown during checkout is the currency applicable to the order. Applicable sales taxes, shipping charges, and discounts are calculated at checkout. You authorize us and our payment providers to charge the payment method selected for the total shown at checkout.

Payment services are provided by third parties. Pretty Selfish does not directly store complete payment-card details.

5. Promotions and discount codes

Promotions and discount codes are subject to their stated terms, availability, and expiry dates. Unless expressly stated otherwise, promotions cannot be combined, applied retroactively, exchanged for cash, or used on excluded products. We may cancel or correct a promotion affected by an obvious error or misuse, subject to applicable law.

6. Shipping and delivery

Processing and delivery estimates, available destinations, tracking, duties, and delay procedures are described in our Shipping Policy. Delivery dates are estimates unless we expressly confirm otherwise. If we cannot ship within a promised period, we will provide the remedies required by applicable law, which may include the option to accept a delay or cancel the unshipped order for a full refund.

7. Returns, refunds, and cancellations

Returns, refunds, product-condition requirements, hygiene-related exclusions, damaged or incorrect items, and cancellation requests are governed by our Return & Refund Policy. Gel nail stickers and other hygiene-sensitive nail products are not eligible for a voluntary return after the packaging or hygienic seal has been opened. This does not limit mandatory rights for defective, damaged, unsafe, misdescribed, or incorrectly supplied goods.

8. Product use and safety

Use products only as directed and stop use if irritation, pain, redness, swelling, or an allergic reaction occurs. Keep products away from children unless the product is specifically intended for them and used under appropriate supervision. Do not use products on damaged, infected, or inflamed nails or skin.

Product information on the website is general information and is not medical advice. If you have allergies, sensitivities, a medical condition, or concerns about whether a product is suitable for you, consult an appropriate healthcare professional before use.

9. Website accounts

If you create an account, you are responsible for maintaining the confidentiality of your credentials and for activity under your account. Notify us promptly at contact@imprettyselfish.com if you suspect unauthorized access.

10. Intellectual property

The website and its content—including the Pretty Selfish name, logos, designs, photographs, product names, text, graphics, and software—are owned by or licensed to Pretty Selfish and are protected by applicable intellectual-property laws. You may use the website only for personal, non-commercial shopping and informational purposes. No content may be copied, reproduced, distributed, modified, scraped, published, or commercially exploited without our prior written permission.

11. Reviews and user content

If you submit a review, photo, comment, or other content, you confirm that it is accurate, that you have the right to submit it, and that it does not violate another person’s rights or applicable law. You grant Pretty Selfish a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, adapt, and share that content for operating and promoting our business, subject to applicable privacy law. We may moderate or remove content that is unlawful, misleading, abusive, or irrelevant.

12. Prohibited use

You may not use the website to violate any law; infringe intellectual-property or privacy rights; transmit malicious code; attempt unauthorized access; interfere with website security or operation; collect other users’ information; submit false information; or conduct fraudulent, abusive, or deceptive activity.

13. Third-party services and links

The website may use or link to third-party services such as Shopify, payment providers, analytics services, social platforms, and carriers. Third-party services are governed by their own terms and privacy practices. We are not responsible for third-party websites or services except to the extent required by law.

Any disclaimer in these Terms applies only to the extent legally permitted and does not exclude warranties, guarantees, or consumer rights that cannot be excluded.

To the maximum extent permitted by law, Pretty Selfish will not be liable for indirect, incidental, special, punitive, or consequential losses arising from use of the website or products. Where liability cannot be excluded, our aggregate liability will not exceed the amount paid for the product giving rise to the claim. These limitations do not apply where prohibited by law, including liability that cannot legally be limited.

16. Indemnification

To the extent permitted by law, you agree to indemnify Pretty Selfish against third-party claims arising from your unlawful misuse of the website, violation of these Terms, or infringement of another person’s rights.

17. Consumer rights and applicable law

These Terms are governed by the laws that apply to the relevant transaction and to Pretty Selfish, without excluding mandatory consumer protections. Canadian customers may have non-waivable rights under applicable federal, provincial, or territorial law. United States customers may have non-waivable rights under applicable federal or state law. Nothing in these Terms limits those rights.

Before starting formal proceedings, please contact us so we can try to resolve the issue. This does not prevent either party from using any remedy or forum available under applicable law.

18. Changes to these Terms

We may update these Terms by posting a revised version with a new effective date. Changes do not retroactively alter completed purchases unless required by law. Continued use of the website after an update means the revised Terms apply to future use and purchases.

19. Severability

If a provision is found unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue in effect.
